Welcome to Alaria! These Terms of Service govern your access to and use of our game, website, and associated services. Alaria is an independent project, set in its own fantasy world, owned and operated by Smashbyte Studio. We have no affiliation with CipSoft GmbH.

By accessing our services, you agree to these Terms. Please read carefully!

1. Acceptance and Eligibility

Minimum Age: Our services are intended exclusively for users aged 18 and over. By creating an account, you declare under your sole responsibility that you are of legal age. Alaria disclaims any liability for false age declarations.

2. Accounts and Security

Your account is personal, non-transferable, and exclusive.

The user is solely responsible for maintaining the security of their account. Alaria is not liable for any losses (including theft of virtual items) resulting from the sharing of credentials or security failures on the part of the user.

3. In-Game Currency and Virtual Content

By purchasing Alaria Coins (our virtual currency) or in-game items (characters, equipment, cosmetics), you do not acquire ownership of those assets.

Nature of the License: What we provide is a personal, non-exclusive, non-transferable, and revocable license to access that Virtual Content.
No Real-World Value: Virtual Content has no monetary value in the "real world" and cannot be redeemed for money. Alaria is not responsible for the trading of accounts or virtual goods for real money (RMT) outside the official Bazar system.
Game Evolution: Alaria is constantly evolving. We reserve the right to modify, delete, rebalance, reprice, or remove any Virtual Content or game mechanic at any time to maintain server balance, without prior notice or entitlement to a refund outside the legal period.

4. Payments and Refunds

Right of Withdrawal: In accordance with Article 49 of the Brazilian Consumer Protection Code (CDC), the user may request a full refund within 7 calendar days of purchasing Alaria Coins, provided the balance has not been spent. If the balance has been partially used, the refund will be proportional to the remaining unused balance.
Fraud: Chargebacks (malicious reversals) or fraudulent transactions will result in immediate suspension and permanent account ban.

5. User Conduct Rules

We have zero tolerance for toxic behavior. Any violation may result in warnings, suspensions, or permanent account removal.

Communication and Respect: Harassment, racism, homophobia, sexism, or any form of hate speech, as well as spam and unauthorized advertising, are strictly prohibited.
Conduct Outside the Game (Streaming): Our rules also apply outside the game environment. Abusive behavior against players or the Alaria team during livestreams, in videos, or on social media is also subject to strict in-game penalties.
Cheating and Third-Party Software: The use of bots, macros, scripts, hacks, bug exploitation (which must be reported immediately), or multiclient is expressly prohibited.

6. Monitoring and Anti-Cheat

To keep the game fair and prevent cheating and hacking, Alaria may actively monitor your use of the services. We may require the installation of anti-cheat software that may run in the background of your device while you play.

7. User-Generated Content and Unsolicited Ideas

Unsolicited Ideas: We value feedback, but please do not send us unsolicited creative ideas or mechanics. Should you do so, you grant us the absolute, perpetual, and irrevocable right to use those ideas without any compensation or obligation to you.
User Content: By streaming or creating content based on Alaria, you grant us a royalty-free, worldwide license to reproduce and use that material in the promotion and operation of our services.

8. Penalties and Due Process

Preventive Suspension: For critical violations (fraud, cheats, or severe bug exploitation), the account will be immediately suspended to protect the integrity of the server.
Right of Defense: The user will be informed of the reason for the penalty and, in cases of permanent ban, will have 72 hours to submit a defense via the ticket system ([email protected]). The administration's decision following review will be final.

9. Disclaimer of Warranties and Limitation of Liability

Alaria's services are provided "as is" and "as available". To the maximum extent permitted by law, Smashbyte Studio makes no warranties that the service will be uninterrupted, error-free, or completely secure. Our maximum liability for any damages or losses caused to you will be limited to the amounts you have paid us in the last 30 days.

10. Legal Compliance and Jurisdiction

We operate in full compliance with Brazilian law, including the General Data Protection Law (LGPD), the Internet Civil Framework, and Law No. 14.852/2024 (Brazilian Electronic Games Legal Framework). Any legal dispute will be governed by Brazilian law and resolved in the court of the consumer's domicile (Brazil). All original content (lore, design, systems) belongs to Smashbyte Studio and is protected by Law No. 9.610/98.
